How the new law changes things for New Jersey Hemp

Bill S3945 pulls unregulated, intoxicating hemp-derived THC products (like Delta-8 or Delta-9 items found in gas stations or smoke shops) into the strict regulatory framework of the Cannabis Regulatory Commission (CRC). This means that online shipping of intoxicating hemp products directly to New Jersey residences is now banned. 

While this might seem like a step back, the new bill is a positive evolution for consumer health in New Jersey. Please note that buying a hemp drink at a liquor store before November will still see new rules in action such as: 

  • Mandatory 21+ ID checks

  • Strict display monitoring

  • A 750ml size cap

  • Resealable packaging requirements for higher-THC drinks

After November 13, the loophole closes entirely. From that point on, these products are legally treated exactly like recreational cannabis and can only be purchased at licensed dispensaries and nowhere else.
